LEGAL TERMS OF L’ABARSET DRAWS

Season 2024-2025

CLAUSE 1. ORGANIZING COMPANY

ENSI, S.A. (henceforth, L’ABARSET) with registered office at Edifici l’Obac, El Tarter, s/n, AD100, Canillo, (Principality of Andorra) and commercial registration number 906009-A, is organizing these draws. 

CLAUSE 2. OBJECT

The purpose of these Legal Terms is to regulate the mechanics of the draws and the awarding of prizes.

L’ABARSET is planning to hold four draws through L’Abarset’s Instagram account (@labarset) during the winter season, among all the participants who meet the requirements established in these Legal Terms. 

CLAUSE 3. PARTICIPATION REQUIREMENTS

All natural persons over the age of 18 who are users of the Instagram social network will be able to participate in the draws.

Employees of Grandvalira Resorts (NEVASA, ENSISA, SAETDE, SECNOA, EMAP and SETAP) are excluded from participating in the draws. 

CLAUSE 4. ACCEPTANCE OF THESE TERMS

Participating in these draws implies full acceptance of these Terms, which will be available to participants through the link in the biography of L’Abarset’s Instagram account. 

CLAUSE 5. TERRITORIAL SCOPE

These draws are open to participants from all countries, but the draws will take place in the territory of Andorra. 

CLAUSE 6. PERIODS OF PARTICIPATION IN THE DRAWS

Four draws will be held throughout the winter season from 10 December 2024 to 19 March 2025. They will be distributed as follows: 

1. Start of first promotion: 10/12/2024 – Date of the draw: 19/12/2024

2. Start of the second promotion: 13/01/2025 – Date of the draw: 19/01/2025

3. Start of the third promotion: 27/01/2025 – Date of the draw: 09/02/2025

4. Start of the fourth promotion: 01/03/2025 – Date of the draw: 19/03/2025 

The participation period for each draw will begin at the time of its publication on the official social network profiles until 23:59 of the day before the draw.

Actions carried out outside this period will be excluded from the draw, even if the other established requirements or conditions have been met. 

CLAUSE 7. GENERAL MECHANICS OF THE DRAWS

During the period of validity of the Draw, customers who meet the requirements set out in these Terms and wish to participate in that Draw, must: 

1. Follow L’Abarset’s Instagram account.

2. “Like” the post announcing the draw on L’Abarset’s Instagram account.

3. Tag in the comments another user of the social network with whom they would like to share the experience of the draw. 

With reference to the third point, each user will be able to tag as many people as they want in the comments, fulfilling the requirement of one tag per comment. The more comments a person makes, the more chances they have to enter the draw. 

CLAUSE 8. PRIZES

Standard list of prizes for the 2024–2025 season: 

1. First draw:  2 Back Stage tickets for L’Abarset Après-ski (with two drinks each). Price per ticket: €130 Total price: €260 (retail price).

2. Second draw: 2 Back Stage tickets for L’Abarset Après-ski (with two drinks each). Price per ticket: €130 Total price: €260 (retail price).

3. Third draw: Lunch or dinner for two at L’Abarset restaurant with closed menu (€80 per person) + 2 Après-ski tickets (€40 per person). Total price: €240 (retail price).

4. Fourth draw: Full Night Pack – 2 Back Stage tickets for L’Abarset Après-ski (with two drinks each) + 2 tickets for the After Party. €130 + €20 per person. Total price: €300 (retail price). 

CLAUSE 9. SELECTION OF WINNERS AND CONDITIONS FOR PRIZE DELIVERY

9.1 Selection of winners 

Winners will be chosen at random using the EasyPromos app or similar. 

The name of the winners will be communicated as follows: 

Through L’ABARSET social networks and/or through the abarset.com website.

L’Abarset will contact the winners through a private message on Instagram within a maximum of 72 hours following the day of the draw. The winners must respond and accept the prize by the same means, within a maximum period of 7 days.

In the event that the prize winner does not contact L’ABARSET within 7 days of being notified or, if they renounce the prize, they will lose their right to claim the prize and the prize will be awarded to the substitute who has been identified by the application used in the draw, up to a maximum of 2 substitutes. In the event that these substitutes do not meet the established requirements, the award will be void. 

9.2 Delivery of prizes

L’ABARSET Après-Ski and VIP tickets will be delivered by email, by means of a reservation voucher.

Lunches or dinners for two people will be delivered by email, by means of a reservation voucher for the winning person. The winning person must reserve a date, through the following email: reservesabarset@soldeu.ad. In the body of the email message, you must specify that you are the winner of the draw and attach the reservation voucher. 

CLAUSE 10. PROTECTION OF PERSONAL DATA

In accordance with the provisions of REGULATION (EU) 2016/679 of 27 April 2016, and Law 29/2021, qualified as protection of personal data, we inform you that the personal data provided is confidential and forms part of the processing owned by Grandvalira, in order to manage your participation in the Draw, unless you tell us otherwise.

You can exercise your rights of access, rectification, deletion, opposition and, where applicable, portability and limitation, by sending a letter accompanied by a photocopy of your ID to the following address: Edifici l’Obac, El Tarter, s/n, AD100, Canillo, (Principality of Andorra) or by sending it by email to reservesabarset@soldeu.ad. 

CLAUSE 11. DISCLAIMER OF LIABILITY

L’ABARSET is not responsible for the possible expectations created by the participants regarding the content of the prizes.

L’ABARSET is expressly and fully exonerated from any responsibility, in relation to the winner of the Draw, arising from any accident, disaster, event or incident that may occur once the prize has been awarded. 

CLAUSE 12. PUBLICATION OF THE WINNERS

By participating in the draw, participants agree that their name and surname may be published on L’ABARSET’s usual social networks (Facebook, Instagram, TikTok), and used in emails and on the website: http://www.abarset.com/ if they end up being a winner. 

CLAUSE 13. LIMITS

The prizes of these Draws, under no circumstances may be subject to change, alteration or compensation at the request of the winner.

Prizes are strictly personal and cannot be transferred, collected or reimbursed in part or in whole, nor can they be exchanged for other services or products.

Waiver of a prize will not give rise to any right to indemnification or compensation. 

CLAUSE 14. MISCELLANEOUS

Modifications and/or annexes: L’ABARSET reserves the right to make modifications or add successive appendices to its mechanics and prizes, as long as they are justified or do not harm the participants, and are duly communicated to them.

In the event that a Draw could not be carried out or if it was necessary to suspend it due to detected fraud, technical errors or any other reason, L’ABARSET reserves the right to cancel, modify or suspend that Draw. 

CLAUSE 15. APPLICABLE LAW

These Terms are subject to the legislation in force in Andorra.

Any discrepancy that may arise in relation to the content, interpretation, compliance and application of this document will be submitted to the judicial bodies of Andorra.
