1. PURPOSE
The purpose of these general terms and conditions (hereinafter referred to as the "General Terms and Conditions") is to regulate the online purchase and sale of event tickets, the reservation of tables in the restaurant and the VIP service (hereinafter referred to as the "Service" or the "Services") offered for sale to the public by the company ESPORTS DE NEU SOLDEU-INCLES, S.A., owner of the establishment the Abarset with commercial registration number 913478Z (hereinafter "the ABARSET") through the website "https://www.abarset.com" (hereinafter, the "Website").
The General Terms and Conditions complete and develop, provided that they do not contradict, the specific conditions (hereinafter, "the Specific Conditions") established by each of the Services selected by the users of the Website (hereinafter, jointly the "Clients", and individually the "Client").
Otherwise, we inform you that, for any questions regarding the use of the Website and/or the Services it offers, ABARSET provides you with the contact email reservesabarset@soldeu.ad and the contact telephone number +376 890 500.
Clients are informed that some of the Services that ABARSET offers through the Website may also be acquired and/or contracted in person. This face-to-face acquisition and/or contracting is governed by the specific Terms and Conditions that are applicable at all times, and which may be different from the Terms and Conditions in force for the acquisition and/or electronic contracting of the same Services.
2. ADHERENCE TO THE GENERAL TERMS AND CONDITIONS
ABARSET asks Clients to carefully read these General Conditions and any applicable Specific Conditions, as well as the Website's Legal Notice, and the provisions of the Website's privacy policy (including the use of cookies detailed in its cookies policy) (hereinafter, together, "the Terms and Conditions"). In any case, access to the Website and/or the use of the Services offered by it imply full and unreserved adherence to the Terms and Conditions.
Therefore, by accessing the Website, the Client declares to have read and understood the provisions of the Terms and Conditions, for which he agrees to comply without reservation, and consents to be bound in an identical way, in general, as if he had accepted them in handwritten form.
In the event that a potential Client does not agree with any issue established in the Terms and Conditions, he/she must not make any use of the Website or the Services.
3. RESERVATION OF THE RIGHT TO MODIFY THE TERMS AND CONDITIONS
ABARSET reserves the right to make, without prior notice, at any time and with immediate effect, any modifications and periodic updates it deems appropriate to the Terms and Conditions.
Therefore, without prejudice to the fact that ABARSET may inform Clients of these changes through, among others, notifications via email, it recommends that Clients review the Terms and Conditions periodically.
4. INTELLECTUAL PROPERTY, INDUSTRIAL PROPERTY, RIGHTS AND POSITIONS OF SIMILAR ECONOMIC CONTENT AND LICENSE OF USE
Definition of the term "content"
When the Terms and Conditions refer to "content", it refers to all the contents that make up the Website and the Services it offers, understood as such, among others, the source code, the design and the navigation structure, as well as the distinctive signs, texts, maps, photographs, videos, etc. the data, databases and other content displayed on the Site and Services.
Rights and legal positions on content provided by ABARSET
The contents published and provided by ABARSET are subject to copyright, trademark rights, patent rights, image rights and/or other rights or legal positions of similar economic content whose ownership belongs to ABARSET or to third parties who have granted the corresponding licences or authorisations. Thus, the use of the Website and the contracting of the Services it offers do not confer on the Clients any ownership or right of use in relation to the aforementioned contents (through, among others, its reproduction, distribution, public communication, making available to the public or transformation), unless ABARSET or the third party holders of the rights or legal positions in question authorise it, either by expressly indicating or allowing it in relation to specific content or by the prior granting of licenses or authorizations formalized in writing.
Consequently, ABARSET reserves the right to use watermarks, technological devices and/or other means that allow the tracking and/or online tracking of unauthorized uses of such content. And, in any case, ABARSET reserves the right to take the corresponding legal action against Clients who infringe the aforementioned copyrights, trademark rights, patent rights, image rights and/or other rights or legal positions of similar economic content.
In the event that any Client considers that any of the aforementioned contents violates their own and/or third parties' rights or legal positions, they may notify ABARSET by means of the contact email address indicated in the "Object" section, so that it can analyse and assess the case in question.
5. USE OF THE WEBSITE
The Client declares that he/she has the necessary legal capacity to be bound by the Terms and Conditions, including the General and Specific Conditions that apply to him/her in each case, stating that he/she understands and accepts them in their entirety. Minors under 18 years of age, however, given that they cannot legally own means of payment, may only acquire the Services in those cases that their parents or legal guardians supervise and are responsible for the aspects indicated in the Terms and Conditions, including the possible fraudulent use of the paid tickets. However, minors under 18 years of age may not acquire Services that they cannot acquire and/or that they cannot enjoy in accordance with the applicable regulations in force at any given time.
By accessing the Website, and by contracting the Services it offers, the Client undertakes, including but not limited to, the following:
(a) To make use of the Website and the Services it offers in accordance with the Terms and Conditions, as well as in accordance with the provisions of the law, morality, public order, good faith and good customs.
(b) Not to contravene the property rights, including intellectual and industrial property rights and other rights and/or legal positions of similar economic content of ABARSET, its suppliers and/or other third parties.
(c) Not to deviate or attempt to divert any functionality of the Site or the Services offered by the Site, from its normal uses, as defined in the Terms and Conditions.
(d) Not to disseminate any data, information and/or other content that has the effect of diminishing, interrupting or preventing the normal use of the Website and/or the Services it offers, or interrupting and/or slowing the normal flow of communications.
(e) Not to make any false or fraudulent purchase of Services. In the event that ABARSET may become aware that the Client is placing false or fraudulent orders, the Client reserves the right to inform the relevant authorities and any third-party providers of the Services in question, and to initiate the legal actions it deems appropriate, without prejudice to other legal actions that may correspond to ABARSET and/or the providers of the Services and/or other third parties that may be applicable to the Client may be affected.
Thus, in general, Clients must use the Website and the Services it offers appropriately, and must not do so to carry out illegal activities that, among others, constitute a crime, violate the rights of other natural or legal persons, or infringe in any other way any applicable legal system.
The Website and the communications that we send you on our behalf or on behalf of third parties may contain links to other external websites, such as, among others, websites of ABARSET collaborators. These websites are not under the control of ABARSET, which the Client acknowledges and accepts. Therefore, ABARSET will not be responsible for the accuracy, compliance with the law, quality or any other aspect of the contents of these websites.
6. INVITATION TO HIRE
The information contained in the General Conditions and the Specific Conditions that may apply, and on the Website, in general, does not constitute an offer to sell by ABARSET, but rather an invitation to the Client to make use of the Services offered by ABARSET and to acquire, where appropriate, the aforementioned Services.
No contract of sale shall exist between ABARSET and the Client in relation to any Service until, in accordance with the General and Specific Conditions applicable to each Service, it has been expressly confirmed by ABARSET, by sending the corresponding purchase confirmation in each case (hereinafter, "the Purchase Confirmation"). Therefore, the formalisation of the purchase contract between the Client and ABARSET will take place when ABARSET sends the Client the Purchase Confirmation. The Client may request the corresponding invoice by sending an email to reservesabarset@soldeu.ad, under the terms and conditions established in the Particular Conditions associated with the corresponding Service.
In the event that the Client's request to purchase the Service and/or the Services (hereinafter, "the Purchase Order") is not accepted by ABARSET, and any amount has been charged to the Client's credit card, this amount will be immediately refunded in full without any surcharge.
7. PURCHASE ORDERS
In the event that ABARSET accepts a Client's Purchase Order, the latter will receive an electronic document formalising the request for the purchase of the Service or Services in question. This document specifies the details of the transaction, including, but not limited to, the description of the Service(s) purchased, its price, and payment terms.
Purchase Orders will only be processed electronically through the Website through the electronic procedures established for each type of Service established in the respective Specific Conditions.
Therefore, the Client must have provided and correctly and fully completed each and every one of the data requested by ABARSET as mandatory.
Once ABARSET has confirmed the Purchase Order, and the payment has been successful, ABARSET will send the Purchase Confirmation to the Client. The Client may request the corresponding invoice by sending an email to reservesabarset@soldeu.ad.
Therefore, as already indicated, the contract for the sale of a Service between the Client and ABARSET will be formalised only once ABARSET sends the Purchase Confirmation to the Client. Notwithstanding the foregoing, and in any case, the Client may expressly request the invoice relating to the Purchase Order in question by sending an email to the address reservesabarset@soldeu.ad.
8. PRICE AND PAYMENT METHOD
1. Price
The full final price of the Services selected for purchase will be displayed to the Client, with the corresponding detail, once the Client has selected the Service that it chooses to purchase, and before the Client is bound by any contract or payment obligation. This price will include the price of all the Services selected including, where applicable, any applicable taxes.
2. Payment method
The price will be paid exclusively by credit and/or debit card.
Payment will be made through an online payment service to which the Website itself will redirect once all the steps have been completed, and the Client has selected the option "Authorise Payment".
The payment service by credit and/or debit card will be provided directly by the issuing entity and, where appropriate, the corresponding credit and/or debit institution. The charge on the Client's credit and/or debit card will be simultaneous with the sending of the Purchase Confirmation. If the payment is not successful, the Purchase Order is not generated. Notwithstanding the foregoing, and in any case, the Client may expressly request the invoice relating to the Purchase Order in question by sending an email to the address reservesabarset@soldeu.ad.
ABARSET does not collect, know or may know to any extent, nor does it store their card details on the Client's device, but it will be the payment service provider itself that will be exclusively in charge of the payment process (the PSP "Redsys", with which all the banks in the Principality of Andorra work together and which has all the guarantees required for this purpose). That is why ABARSET is excluded from any liability in relation to the breach by third parties of the confidentiality and security of the information and data provided by the Client when paying for their electronic purchases by credit and/or debit card when such breaches are beyond their control.
By registering the means of payment, the Client declares that he/she is the holder of the card associated with the payment and that it is valid, valid and under his/her control. Likewise, the Client declares that it does not appear on any blacklist of a bank.
The use of a card that is not owned by the Client will be considered fraudulent use, with the Client being responsible to the cardholder, and to third parties, for the consequences arising therefrom and guaranteeing the indemnity of ABARSET in this regard.
When the amount of a purchase is charged fraudulently or improperly using a payment card number, the cardholder may demand the cancellation of the charge provided that the cancellation has been carried out by virtue of the conditions established by the issuing entity and/or the credit institution responsible for the credit card, and, where appropriate, the corresponding insurance relating to the card. In this case, the corresponding entries of indebtedness and reimbursement to the accounts of ABARSET and the holder will be made as soon as possible. However, if the purchase has indeed been made by the cardholder and, therefore, the cardholder has unduly demanded the cancellation of the corresponding charge, the Client will be obliged to ABARSET to compensate for the damages caused as a result of said cancellation.
3. Expenses and taxes
Any applicable taxes will be borne by the Client, who must pay them together with the prices of the Services.
The amounts that apply will be included in the total to be settled by the Client, both at the time of making the Purchase Order and in the Purchase Confirmation and, where applicable, in the invoice.
9. PRIOR INFORMATION TO CONTRACTING
In accordance with the provisions of current Andorran legislation on consumer protection and contracting in the digital space, ABARSET informs the Client that:
- The purchase contract (i.e. the different documents that make it up, including the Terms and Conditions, the Purchase Order and the Purchase Confirmation) will be formalised in Catalan and, if applicable, additionally in Spanish, French or English.
- The Client may identify errors in the entry of their data in the Purchase Order once it has been received by email. To correct an error in the entry of their data once the Purchase Order has been made, the Client, immediately upon identification of the error, must contact ABARSET by contacting email dpd@soldeu.ad and contact telephone number +376 890 500, in order to request any modifications that may be appropriate.
- The documentation, data and information relating to each purchase contract will be kept in accordance with the provisions of ABARSET's privacy policy.
10. AVAILABILITY
All Purchase Orders are subject to the availability of the Services in question.
In the event that at the time of receipt of a Purchase Order there is no availability of the Services subject to it, in accordance with current Andorran legislation on trade and consumer protection, ABARSET must inform the Client of this circumstance, who is entitled to recover the sums paid within 30 days at the latest.
11. SPECIFIC CONDITIONS OF ABARSET SERVICES
The Specific Conditions of each Service offered on the Website are detailed below:
A. TICKETING SERVICE
1. Purpose
The ABARSET Ticket Sales Service allows Clients to purchase tickets for access to the Après-Ski and After-Party events organised by ABARSET.
This Service allows Clients to purchase tickets for events that take place at ABARSET's facilities, including the Après-Ski, which takes place in the afternoon, and the After-Party as a separate evening event. People under 18 years of age do not have access to the aforementioned events.
By purchasing tickets, users accept the conditions established in these Particular Conditions, as well as the rules of use and access to the venue where the Services are carried out. Clients, when proceeding to formalise Purchase Orders for this type of Services, must bear in mind the legal limitations established in section 5 of the General Conditions.
2. Ticket Purchase Order formalisation process
- Tickets for Après-Ski are sold in phases (release) according to the corresponding artist(s) and their availability. Prices and the number of tickets per phase may vary at the discretion of ABARSET. Notwithstanding the foregoing, the Client will always have at their disposal before, during and once the Purchase Order has been formalised, all the amounts relating to the price of each ticket, as well as other amounts that may be applicable to the Service or the applicable taxes. In any case, the provisions of section 8 of the General Conditions apply to this Service, relating to the price and method of payment for the Services.
- Tickets for After-Party events will have a fixed price that will be indicated at all times for each specific event, as long as the purchase is in advance. The established price may be modified at any time by ABARSET, without the need for prior notice, depending on commercial criteria, availability or other operational circumstances.
- Tickets are purchased through the website, which redirects to the platform of ABARSET' s ticketing provider (called Sigandgoo), for both Après-Ski and After-Party events.
- The Client may purchase a maximum of 10 tickets per Purchase Order.
- In order to formalise Purchase Orders for events held at ABARSET, the Client must prove that they are of legal age (+18 years old) by means of an original identity document (passport or national identity card) at the time of accessing the ABARSET facilities.
- The only official ticket sales channel is this website, and eventually the official websites of the promoters with which ABARSET may collaborate at any time. Under no circumstances is the resale of tickets allowed, and ABARSET is not responsible for incidents in the case of tickets purchased through unofficial channels.
- The programming of ABARSET's DJs and/or shows are subject to possible discretionary modifications by ABARSET's team, which will be notified as far in advance as possible to Clients who have already formalized Purchase Orders.
2. Access and opening hours
- The Après-Ski schedule will be from 4:00h p.m. to 9:00h p.m. from Monday to Sunday, except on Saturdays and on special occasions, when it will be extended until 10:00 p.m. Likewise, on certain Fridays, the schedule may be extended until 9:30 p.m., according to the schedule established by the ABARSET organization.
- The After-Party schedule is from 10:00h pm to 02:00h am. Exceptionally, on special occasions, the hours may be extended until 04:00h am.
- When accessing the ABARSET facilities, if the Client wants to purchase drinks, the first drink will have a surcharge of €1 as a reusable cup.
- Access will not be allowed if the QR code at the entrance to the ABARSET access control points is not shown and sent to the Client once the Purchase Order has been confirmed in their email. The Client must show their official identification documentation (passport or national identity card) if necessary, if required by ABARSET's security personnel, in order to prove the age of majority.
- All attendees at ABARSET events are required to respect the code of conduct established by ABARSET. ABARSET reserves the right of admission to the entire venue where the events are held, and may deprive entry to all those who do not respect this code (https://www.abarset.com/ca/10-manaments). In the event of denied entry or in the event of expulsion once inside the venue, ABARSET will not refund the amount or exchange the ticket for another date.
- Tickets are not nominative; access to the event is granted to whoever presents the corresponding QR code.
3. Return Policy
- The refund of tickets before and after the event is allowed as long as the Client has not attended and alleges a cause of force majeure that justifies it. In the event of force majeure, the Client must contact reservesabarset@soldeu.ad to explain the case in detail, which will be assessed by the ABARSET reservations team. Force majeure shall be considered to be any unforeseeable, unavoidable event that is beyond the scope of ABARSET or the Client, such as, but not limited to, natural phenomena, health crises or unforeseen circumstances of a technical nature.
- In the event of cancellation of an event by ABARSET, the Client will be notified via email and social networks, as far in advance as possible. ABARSET will only cancel events for reasons of force majeure, in accordance with the provisions of the previous point. In this case, the notification will always be carried out through official channels and the amounts paid will be refunded in accordance with the Purchase Orders formalized by the Clients.
B. RESERVATION SERVICE AT THE ABARSET RESTAURANT
1. Purpose
ABARSET's Restaurant Reservation Service allows Clients to request and guarantee a table in the restaurant in advance through the Cover Manager online platform enabled on the Web for this purpose. This system facilitates availability management, ensures the correct planning of bookings and offers Clients the possibility of confirming, modifying or cancelling their booking following the particular conditions of this Service.
2. Booking Procedure
- To make a reservation, the Client must access the Website and select the reservation option of the ABARSET restaurant existing for this purpose.
- The Client will be redirected to the ABARSET provider's platform (called Cover Manager) to complete the process, where they must indicate the number of people for whom they wish to proceed with the booking, and the Client's contact details, among others.
- For reservations of up to 10 people, it is required to select the number of guests, the date and the desired time.
Reservations for groups of more than 11 people must be managed manually by contacting the restaurant via email reservesabarset@soldeu.ad.
3. Confirmation and payment
- ABARSET, in order to guarantee the reservation, will require the introduction of a credit and/or debit card by the Client.
- The Client's request for a credit and/or debit card is required only as a guarantee measure to secure the reservation and no prior charge will be made, except in the cases provided for in the cancellation policy detailed in the following point.
- In the event that the Client does not show up to enjoy the reservation (no-show) or cancels the reservation after the established period, ABARSET reserves the right to make a charge of €10 per person declared at the time of booking, according to the specific cancellation conditions detailed in the following point.
- If the credit and/or debit card is not entered, the reservation will be considered pending confirmation and this fact will be notified by the email provided by the Client so that they can complete the reservation process indicated in the previous section. If the Client does not provide their credit and/or debit card details within 24 hours of the start of the booking process, the system will understand that the Client has finally not wanted to proceed with the formalisation of the booking. In any case, the Client can always initiate a new booking process.
In case the credit and/or debit card is entered correctly, the Client will receive an email confirming their reservation.
4. Modification and cancellation policy
- Reservations can be modified depending on the availability of the restaurant, as long as it is done with a minimum notice of 24 hours regarding the date and time of the reservation made.
- The Client will receive an email days before the booking to confirm or cancel it.
- In the event of a no-show or cancellation of the reservation in advance upon receipt of the email and/or SMS referred to in the previous section, ABARSET may charge the Client's credit and/or debit card in accordance with the provisions of the previous point, relating to the confirmation and payment process.
- Table reservations will be kept for a maximum period of 15 minutes from the time established in the reservation. If this time has elapsed without the Clients having arrived, ABARSET reserves the right to make the table available for other Clients.
- Likewise, in the event of non-compliance with the indicated deadline and absence of the Client, ABARSET may apply the guarantee clause, making the corresponding charge of €10 per person to the credit and/or debit card provided at the time of booking by the Client.
5. Group bookings
- Reservations for groups of more than 11 people must be managed manually by contacting the restaurant via email reservesabarset@soldeu.ad.
- Once the request has been received, ABARSET will provide detailed information on the menus and the specific conditions for groups.
- The reservation confirmation will be made manually by the restaurant staff.
6. Miscellaneous
- ABARSET reserves the right to modify or cancel bookings for operational reasons or force majeure, notifying Clients as far in advance as possible.
- Improper use of the reservation system may lead to the cancellation of the reservation without the right to claim by the Client.
C. VIP SERVICE
1. Purpose
VIP Services offer Clients an exclusive experience within ABARSET's facilities, providing access to reserved areas with preferential attention and additional services.
2. Contact
The Client may contact ABARSET to contract the VIP Services by email, telephone, WhatsApp or the contact form available on the Website:
a. Email:
- The Client must send an email to the address indicated in the "Contact" section of the Website. The ABARSET reservations team will contact the Client by email with the detailed quote, which may vary depending on the day of the week.
- The Client must accept or cancel the proposal issued by the ABARSET reservations team. If the Client accepts it, the following information will be requested through their email address, which must be detailed: full name, email, telephone number and number of people who will attend. Then, once this information has been provided, you will receive the link for payment by virtual POS, in accordance with the provisions of section 8 of the General Terms and Conditions. The reservation will not be confirmed until ABARSET receives the payment from the Client.
b. WhatsApp:
- The Client can contact ABARSET reservations team by WhatsApp, through the telephone number +376 326 725. Once the communication has been received by this channel from the ABARSET reservations team, an automated message will be sent to the Client requesting the following information that must be detailed: full name, email, telephone number and number of people who will attend. When the Client provides an email, they will receive a link for payment by virtual POS, in accordance with the provisions of section 8 of the General Terms and Conditions.
c. Telephone:
- The Client can contact the ABARSET reservations team by phone, using the telephone number +376 326 725. Through it, they will be provided with the amount of the reservation you want to formalize at the time of the call. If the Client is interested, they will be asked for their email address to send them the request for information that must be detailed: full name, email, telephone number and number of people who will attend. Then, once this information has been provided, they will receive the link for payment by virtual POS, in accordance with the provisions of section 8 of the General Terms and Conditions.
d. Contact form:
The Client can use the contact form available in the "Contact" section of the Website. Once the ABARSET reservations team receives the contact form processed through the Website, the ABARSET reservations team will respond by requesting the required information, indicating the quote, and will follow the rest of the procedure described in these Specific Conditions.
2. Payment
The Client will receive a virtual POS link managed by ICS (Sighore) and will be redirected to Redsys to formalize the payment. No additional information will be requested from the Client.
Once the payment has been made, the reservation will be confirmed.
The Client will receive:
- a) A Purchase Order confirmation email.
- b) An email with the QR code necessary to access the car park (for more information see the following link: https://www.abarset.com/faqs). A parking QR will be provided for every 5 people.
3. Additional service to VIP Service: Backstage
- This Service includes one wristband per person, which includes two drinks per person.
- The Backstage Service is only offered in the same week in which an event is held in which this particular service is offered and only if capacity permits (or in specific cases of specific events). The Client must contact the ABARSET team to confirm whether the Backstage Service is available on the date they wish to purchase.
- Payment will be made by virtual POS terminal, following the same procedure described above in section 2 of these Specific Conditions and the provisions of section 8 of the General Conditions. In those cases, in which the Client wishes to purchase the VIP service once it is already at ABARSET's facilities, the Client may purchase the Backstage Service by making the payment at the ABARSET physical cashier.
- Clients who purchase the Backstage Service must arrive at the event together.
4. Consumption conditions and capacity of the VIP Service
- The agreed consumption of beverages may only be carried out on the specified day and exclusively in bottles, not in glasses. However, once they are at the VIP facilities, Clients may purchase the individual glasses they wish, at the prices established at any time in the VIP Service.
- The deadline for arrival is 6:30h p.m.
- The amount not consumed for the consumption of beverages will not be refunded to the Client.
- In the event of the Client's absence without notice of at least 48 hours, no refund will be made.
The Client who contracts the VIP Service will agree with the ABARSET reservation service the total number of people who will have access to the corresponding service. This total number of people must be respected on the day of the event by the Client, and any modification will be subject to the availability of capacity for the ABARSET VIP Service and the application of the corresponding economic conditions by ABARSET. In the event that the number of attendees is lower than that initially indicated, the Client must pay the entire agreed amount.
- If the Client wishes to cancel the VIP Service 48 hours in advance, he/she may request a change of day from the ABARSET reservation service, adjusting the rate to the new assigned day, provided that there is availability. To proceed with the request for cancellations and/or modification of the day of access to the VIP Service, the Client must send an email to reservesabarset@soldeu.ad.
- If a bottle is not fully consumed, the Client may take it away. However, it will not be possible for ABARSET to store it for future events in which the Client acquires the ABARSET Services again.
- Part of the amount paid by the Client can be used to eat, but only what appears on the VIP Service menu can be consumed.
- In the VIP Service, the bottles will be served according to the previously accepted consumption, according to the rates in force at all times.
5. Reservation and Allocation Policy
- The payment made by the Client will be recorded as a payment on account until the consumption is completed.
- Cash payments over €9.999 are not permitted.
- Payments cannot be made with American Express cards.
- Reservations are indivisible and must be consumed exclusively at the table assigned by the ABARSET reservations team to the Client. They cannot be transferred to other tables.
- ABARSET will assign the tables according to the number of people and the order of reservation. Clients will not be able to choose the location of the table.
6. Access on the day of the event
- The Client will access the car park with the QR provided at the time of completion of the purchase of the VIP Service described in point 2 of these Specific Conditions (for more information see the following link: https://www.abarset.com/faqs). Afterwards, you can enter to ABARSET through the VIP door.
- The hostesses at the VIP gate will have a list with the name and surname of the Client. With this information, the necessary VIP wristbands will be delivered, which must be shown to the security personnel to access the ABARSET.
12. RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to the purchase of tickets for events held at ABARSET, as they are understood as cases exempted from the right of withdrawal recognised by Law 12/2013, of 13 June, on commerce.
13. COMMUNICATIONS
1. Communication channels
Any communication between the Client and ABARSET regarding a specific Purchase Order may be made by ordinary mail or e-mail, or by telephone.
For the purposes of communications by ordinary mail, e-mail or telephone, ABARSET designates the following addresses:

The address of the Client for the purposes of communications will be the one that in each case the Client designates in the Purchase Order, or the one that appears after the Client has modified such address in accordance with the provisions of these General Conditions.
Any communication relating to a Purchase Order delivered to the addresses indicated above shall be deemed to have been correctly made, unless the addressee has notified the sender, prior to placing the Purchase Order, of a change of address.
2. Complaints and Other Communications
The Client may submit their claims and make any other communication to ABARSET by ordinary mail or email, at the addresses established in the previous point.
Likewise, the Client may submit their complaints, claims and reports to the Trade and Consumer Unit of the Government of Andorra using the form found at this link: https://www.e-tramits.ad/tramits/ca/formulari-de-queixa-reclamacio-i-denuncia-de-consum/p/GV001563.
14. PROHIBITIONS AND LIABILITY
1. Prohibitions
Access to ABARSET with food or drink from outside is prohibited, as well as access with illegal objects or substances and/or those that may endanger the safety of any person who is inside its facilities. ABARSET may carry out security controls at the entrances to its facilities and reserves the right to deny access to people who want or intend to access with the aforementioned objects or substances.
2. Liability
Unless for any specific case it is not permitted by applicable legislation, ABARSET's liability in relation to any Service acquired through the Website will be limited to the purchase price of the Service in question. ABARSET will not be liable for indirect damages caused to the Client, nor for loss of profit.
In no case will ABARSET be responsible for the loss or theft of personal belongings within its facilities. In the event of injuries or accidents occurring in said facilities, except for intent or negligence, ABARSET is not responsible for the injuries or accidents in question.
The Client is responsible at all times for the behaviour within the ABARSET facilities, as well as for their conduct which, in the event that it is inappropriate, may result in expulsion without the right to refund.
In any case, the Client assumes that many of the ABARSET events are held in an outdoor space and, therefore, the Client is exposed to low temperatures and eventual precipitation in the form of snow or water. Likewise, the Client accepts that the volume of music in ABARSET facilities may be high for those who have hearing sensitivity, so it is recommended that they take the necessary hearing protection precautions to enjoy the events they attend.
Likewise, Clients must comply at all times with the safety and health measures established by ABARSET, as well as its evacuation policies and procedures in cases of emergency.
However, all the rights that current Andorran legislation recognises to consumers are guaranteed.
2. Force majeure
In cases of force majeure, ABARSET will not be liable for damages arising from non-compliance in relation to the acquisition or provision of a Service.
Force majeure causes include, but are not limited to, any act or event beyond the reasonable control of ABARSET, including, but not limited to, general or sectoral stoppages that affect the provision of the Services, adverse weather conditions, natural phenomena, fires, floods or thefts in ABARSET's facilities, epidemics or other health crises, and other force majeure situations that make it impossible or significantly difficult to provide the Services.
15. COMMERCIAL COMMUNICATIONS
ABARSET may send commercial communications to Clients who have purchased Services relating to ABARSET's activity. In the event that at any time the Client does not wish to receive any more commercial communications from ABARSET, they may do so by using the link available for this purpose at the bottom of any commercial communication received from ABARSET.
16. RIGHT OF EXCLUSION
ABARSET reserves the right to deny or suspend, without prior notice and at its discretion, at any time and permanently or temporarily, access to the Website, and to the Services it offers, to Clients who fail to comply with the Terms and Conditions. This power of ABARSET is without the right of the Clients to any compensation for damages, and without prejudice to any legal actions that ABARSET may initiate against them.
17. PARTIAL NULLITY
If any of the provisions of the Terms and Conditions are declared null and void by a final resolution issued by a competent authority, the rest of the provisions of the Terms and Conditions will remain in force and will not be affected by such declaration of nullity.
18. MODIFICATION
The Terms and Conditions may be modified by ABARSET. It is the Client's responsibility to read them periodically, given that the Terms and Conditions in force at the time of accessing the Website or at the time of entering into the contract for the sale of Services will be applicable.
19. GOVERNING LAW AND JURISDICTION
The Terms and Conditions will be governed by Andorran law.
Clients submit to Andorran jurisdiction, expressly waiving any other jurisdiction that, in accordance with the Law, may correspond to them.
The foregoing is without prejudice to the fact that, due to the condition of a user as a consumer, other legislation and/or jurisdiction may be applicable by law.
