Ownership and purpose of the Website
In accordance with the requirements of Law 20/2014, of 16 October, regulating electronic contracting and operators that carry out their economic activity in a digital space, we inform you that you have accessed a website (hereinafter, "the Website") which domain name (www.abarset.com) is owned by the Andorran trading company ENSI, S.A. (hereinafter, "ABARSET"), duly registered in the Companies Registry of the Government of Andorra under number 5009, with commercial registration number 906009-A and with tax registration number A-700159-E. Its registered office is located at Edifici Obac, El Tarter, s/n, AD100 Canillo, Principality of Andorra.
The purpose of the Website is to inform about the services, events and other activities and initiatives offered by ABARSET (hereinafter, jointly, "the Initiatives"), as well as to allow reservations and purchases in relation to the Initiatives.

Acceptance of the Terms and Conditions of Use of the Website
Access to the Website entails the full acceptance, by its users, of these terms and conditions of use, as well as of the privacy policy and the "cookies" policy, all of which are also available therein (hereinafter, jointly, "the Terms and Conditions").
Likewise, users of the Website undertake to make diligent use of it and the contents contained therein, in accordance with the provisions of current legislation, as well as with good faith and good customs, and without contravening morality or public order.
Therefore, among others, access to the Website or its use for illegal purposes is not permitted, so it is forbidden, by way of example and not limitation, it is prohibited:
- Use the Website in a way that may cause damage, interruptions, inefficiencies or defects in its operation;
- Use the Website for the transmission, installation or publication of any virus, malicious code or other harmful programs or files;
- Use the Website to collect, without authorisation, personal data from other users;
- Gain unauthorized access to networks or information systems connected to the Website, by means of hacking or forgery, password extraction or any other illegal means;
- Break, or attempt to break, the security or authentication measures of the Website or any network or information system connected to it, or the security or protection measures inherent in the contents of the Website; or
- Carry out any action that causes a disproportionate or unnecessary saturation of the infrastructure of the Website or the networks or information systems connected to the Website.
Reservation of the right to modify and update the Terms and Conditions of use of the Website
ABARSET reserves the right to make, without prior notice, at any time and with immediate effect, any modifications and periodic updates it deems appropriate to the Terms and Conditions. Therefore, ABARSET recommends that users of the Website review the Terms and Conditions periodically.
Rights and legal positions on the contents of the Website
- Definition of the term "content":
For the purposes of the Terms and Conditions, the term "content" refers to all the contents of the Website, understood as such, by way of example and not limitation, the source code, design and navigation structure of the Website, as well as the distinctive signs, videos, photographs, illustrations, graphics, texts, data and other information displayed.
- Rights and legal positions on content:
The contents are subject to intellectual property rights, industrial property rights, image rights and/or other rights or legal positions of economic analysis owned by ABARSET or by third parties who have granted the relevant licences or authorisations. Therefore, access to the Website does not grant users any ownership or right of use over the content (through, among others, its reproduction, distribution, public communication, making available or transformation), unless ABARSET or the third parties holders of the rights or legal positions in question authorise it either expressly indicating it on the Website or by means of prior written licences or authorisations to that effect.
Therefore, ABARSET reserves the right to make use of watermarks, technological devices or other security means that allow the tracing or online tracking of unauthorized uses of the contents. And, in any case, ABARSET reserves the right to bring the corresponding civil or criminal legal actions against users of the Website who infringe intellectual property rights, industrial property rights, image rights or other rights or legal positions of economic analysis that fall on the contents.
In the event that any user considers that any of the content violates the rights or legal positions of third parties, they must immediately notify ABARSET by the means of contact or complaint indicated in the section "Ownership and purpose of the Website", so that this company can analyse and assess the case in question.
Right to opt out of the website
ABARSET reserves the right to deny or suspend, without prior notice and at its discretion, at any time and permanently or temporarily, access to the Website to users who fail to comply with the Terms and Conditions. This power of ABARSET is without prejudice to the possible legal actions of the civil or criminal order that it may initiate against the users in question.
Responsibility

Users shall be solely responsible for taking all appropriate measures to protect the devices and associated computer programs by which they access the Website from, but not limited to, viruses, malicious code, or other harmful programs or files.
Users will be solely responsible for the use they make of the content provided through the Website.
In the event that they make queries or claims to ABARSET by the means provided for in the section "Ownership and purpose of the Website", users will be liable for any damages caused to the company or to third parties by having provided false or inaccurate data or information.
Users will also be liable in all other cases in which they breach the Terms and Conditions, as for now, by way of example and not limitation, in the cases indicated in the section "Acceptance of the Terms and Conditions of use of the Website".
- ABARSET's responsibility
ABARSET will not be liable for damages or other consequences arising from the use that users make of the Website or the contents it contains.
ABARSET will not be liable for damages or other consequences arising from the unavailability of the Website or its contents for technical, security, control, updates or maintenance reasons, or for errors due to servers or third-party intermediaries or suppliers, such as deficiencies in telephone lines or Internet overloads.
ABARSET will not be liable for any damages caused to users of the Website by malicious computer programs, actions of cybercriminals or other illegal interference by third parties.
ABARSET does not exercise any control over the services, content and/or other elements that users of the Website may access through technical devices of links, directories or other means that can be accessed through the Website (such as Facebook, Instagram, TikTok, X, LinkedIn and similar). Therefore, ABARSET will not be responsible for the technical availability, quality or accuracy, among others, of the services, contents and/or other elements that have been accessed, nor for any damages or other consequences that may occur as a result of their use. In no case does the existence of the aforementioned accesses presuppose the existence of agreements with the owners or those responsible for the services, content or other elements in question, nor the recommendation, promotion or identification of ABARSET with them.
Users who decide to visit and/or use any of the third-party links do so at their own risk, and must take the appropriate protection measures.
Without prejudice to the foregoing, in the event that any user considers that any of the technical devices of links, directories or other means that can be accessed through the Website violates the rights or legal positions of third parties, they must immediately notify ABARSET by the means of contact or complaint indicated in the section "Ownership and purpose of this website", so that this company can analyse and assess the case in question.
ABARSET may, temporarily or permanently, interrupt access to the Website, in the event that it is unable or simply does not want to continue exploiting it; in these cases, the access of the users will be cancelled immediately without the users being able to demand responsibilities from ABARSET.
Likewise, ABARSET reserves the right, at any time and without prior notice to users, to modify any content of the Website, or to update or correct errors or inaccuracies, without users being held liable.
As long as it does not contradict the provisions of current legislation, in the event that, eventually, ABARSET is held liable for damages to users of the Website, the liability of the company will be limited to certain, real and specific damages.
Notwithstanding the foregoing, ABARSET will not be liable under any circumstances for damages or other consequences arising from the breach of the Terms and Conditions by users.
Links to the Website
Any link from third parties to the Website may not imply an unfair use of its contents, unless the third parties in question have obtained the prior written authorisation of ABARSET.
Likewise, ABARSET prohibits the creation of links to the Website from other websites with content that is contrary to the law, good faith, good customs, morality or public order.
In no case should the existence of links relating to third parties presuppose the existence of agreements with the owners or those responsible for them, nor the recommendation, promotion or identification of ABARSET with the statements, contents, goods or services offered. Users who decide to visit and/or use any of the aforementioned links relating to third parties will do so at their own risk, and must take the appropriate protection measures.
Applicable Law to the Terms and Conditions, and Jurisdiction
The Terms and Conditions will be governed by Andorran law.
Users of the Website submit to Andorran jurisdiction, expressly waiving any other jurisdiction that, in accordance with the Law, may correspond to them.
The foregoing is without prejudice to the fact that, due to the condition of a user as a consumer, other legislation and/or jurisdiction may be applicable by law.
